The Validity & Viability of a Waqf based banking model in the UK

Research conducted by Sameen Zafar, University of Nottingham, UK. Waqf (plural: Awqāf), is a type of charitable giving in the form of an endowment that is dedicated for the sake of God (Allah), to serve the public good. It is a mechanism that is based in Islamic tradition and has historically been widely utilised across the world as a form of ongoing charity (Sadaqah Jariyah). This has taken many forms, from the building of schools and hospitals from properties that have been designated as Waqf, through to the disbursement of funds towards community projects, earned from Waqf property rent or hire. The earliest known examples of Waqf use in the Islamic tradition date back to the time of the Prophet Muhammed pbuh , when two of his closest companions Umar and Uthman (may God be pleased with them both) were involved in charitable endowments that were used for public good, as in the case of some land in Khaybar and the Rumah well, both located in modern day Saudi Arabia. The land in Khaybar that was designated as Waqf by Umar (may God be pleased with him), was to be used for the public good and could not be bought or sold for private gain. As a result, the land was farmed and the fruits distributed to the poor within the community. Any income generated from the land was used to pay for the freeing of slaves (as slavery still existed as an institution), and to provide for the needs of guests and travellers to the city. Similarly, the Rumah well was purchased and designated as a Waqf by Uthman (may God be pleased with him) at a time when water had become scarce and inaccessible for much the community. Research conducted by Mohammad Abdullah Nadwi, Markfield Institute of Higher Education, UK. This paper explores the concept of Waqf, its role in contemporary society and its growth, usage and methods of implementation. The programmes reveals that historically, Waqf was well established during the period of Islam’s establishment in the seventh century and went on to become utilised with a variety of driving forces across the growing Muslim world in the centuries which followed. However, having been marginalised as an effective social development tool in more recent generations, contemporary Muslim societies across the globe are now witnessing a revival of Waqf awareness and value. Furthermore, this study focuses on Waqf in Muslim minority environments, exploring contemporary Waqf usage in comparison to permanent legal trusts in England, offering tangible strategic and procedural proposals for the enhancement of effectiveness in contemporary Awqāf, particularly in the United Kingdom. In the broader context, we at Islamic Relief Academy are keenly engaged in exploring key issues around faith and development, including fiscal aspects of Islam, such as Islamic philanthropy, Waqf and Islamic microfinance. Consequently, published programmes can inform the development sector through empirically-based, evidential programmes in the field of Islam and development and, more broadly, lend our support for the positive value faith adds to humanitarian and development work. Growing up with war and insecurity, their lives have been marked by poverty and turmoil. Instead of running from classroom to playground they seek refuge in makeshift homes and worry about where their next meal will come from. Poor general health is common in Chechen children, usually caused by an absence of nutritious food in their diet. Few can afford to eat three meals a day and as a result, suffer from a variety of health problems, some of which directly affect their academic performance. Working Towards a Better Future Why Waqf ? A lasting gift to those in need Waqf (plural: Awqaf) is a form of Sadaqah Jariya (ongoing charity) in which a gift is donated to bring a charitable return. The original gift is invested to make a profit for the cause to which it is donated, but cannot be sold. If for example, a field is given as a Waqf, the crops and benefits derived from it can be used by the charity, while the field is held intact as the original investment. Waqf in history Since the time of the Prophet, Waqf generally took the form of a donated property or an institution to help others. For example, houses were converted to inns for travellers, waterways were built to bring water to villages, hospitals were built to provide free medical treatment, schools were built to provide free education, and kitchens were established to feed the poor. The most recent model is that of the Ottoman Imaret which combined all of these social services under one roof. Ten Steps for Permanent Waqf Donating for Waqf is a highly righteous deed. Waqf has a great impact on society because it is an ongoing charity which provides a continuous benefit to people. It is characterised by longevity and sustainability. Allah (SWT) urged to us in the Holy Quran, in several verses, the importance of leaving behind a legacy due to its benefit to society We record that which they send before and that which they leave behind . This includes the impact of any good deed that continues to benefit others. The prophet Muhammad (p.b.u.h) said: “When a person dies, his actions come to an end except for three; ongoing charity, beneficial knowledge or a righteous offspring that make ‘Duaa’ (supplication) for him”. Leading by example, the prophet (p.b.u.h.) was the first person in Islamic history to make Waqf of seven orchards. He also encouraged his companions to make Waqf. As people are responsible for what they do during their lives and what they leave behind them, scholars advise able Muslims to make the necessary arrangement for their Waqf, while they are alive, and advise them not to rely on others to act after they have passed away.   In the twelfth year of Islamic Relief’s Waqf programme, it gives me great pleasure to report on the performance of your Waqf contributions and on the life-changing support your generosity has provided. It is with the support of people such as yourself that we are able to carry out such vital work, the fruits of which can be seen in the benefit derived by the beneficiaries, who are able to gain an improved quality of life. Alhamdulillah. From our investment of the Waqf funds during the year 2011, we used the profits to fund a variety of projects in 2012: from life-saving food distribution in war torn Syria, to providing health screening for orphans & children in Sri Lanka, providing water and sanitation for conflict affected population in Sudan and implementing sustainable livelihood project in Indonesia. It is only by the Grace of Allah (SWT) through donors like you that Islamic Relief can achieve all it does in the past year for the poor, the needy and the destitute.
